The national convention is the largest annual gathering organized by The American Legion. Representatives from each of the Legion's 55 departments, including the 50 states, the District of Columbia, the Commonwealth of Puerto Rico, France, Mexico, and the Philippines, are allocated a minimum of five voting delegates. Additionally, each department receives one extra delegate--a member in good standing--for every 1,000 members or major fraction thereof, 30 days prior to the convention. The group of delegates is completed by the five vice commanders who are elected annually. These national convention delegates hold the exclusive authority to approve amendments to the Legion's constitution and bylaws. They are also tasked with passing resolutions that guide the direction of the Legion, establish membership fees for the following year, and choose a national commander along with five national vice commanders who will serve until the subsequent convention.

Selection of convention host cities is based on various considerations such as hotel room availability, pricing, meeting venues, city amenities, and alignment with the national organization and departmental requirements. Proposals to host the convention are welcomed from interested cities.
